The Chinese-citizen seven-year category differs from the non-Chinese category requiring seven continuous years immediately before application and a declaration that Hong Kong is the permanent residence. Ordinary residence involves lawful, voluntary residence for a settled purpose. Temporary absence does not necessarily break it: reasons, duration, frequency, habitual home, employment and principal family location matter. Foreign domestic-helper service, specified imported-worker periods, breaches of stay conditions and other statutory exclusions cannot simply be added to the qualifying period.
What to do, step by step
- Identify the nationality category using Immigration's definition. A foreign passport does not necessarily establish a change from Chinese nationality. List the first lawful residence, scheme changes and any gaps, rather than selecting whichever category appears easier to satisfy.
- Create yearly folders with consistent tax, employer or school, housing and bank records. Where months are missing, seek genuine alternative records. Do not manufacture salary or residence evidence merely to create an apparently continuous paper trail for the period.
- Build an absence table from travel records, explaining family care, posting, study or holidays and the evidence for each period. Show retained Hong Kong connections. There is no universal safe absence-day shortcut that replaces assessment of the actual circumstances.
- Non-Chinese applicants additionally organise permanent-home evidence about habitual residence, family, support and tax. Apply for verification after the relevant period is met and maintain valid stay while assessment is pending; filing a claim alone does not extend immigration permission.
Costs, timing, and things to check
Property ownership, company registration, tax payment or a talent visa alone does not guarantee permanent status. Evidence should explain the real pattern of life, not simply provide seven renewal notices while leaving residence and absences unexplained.
A non-Chinese permanent resident's later lengthy absence can engage separate rules on loss of status. Qualification for residence, retaining permanent status and Chinese-nationality requirements for an HKSAR passport are separate questions to check for the intended future arrangements.
