What to have ready
Current support and whom it serves
If a court maintenance order is unpaid, check the appropriate enforcement and attachment-of-income route. The court makes an AIO directing a specified income source to pay as ordered, potentially covering arrears and future sums. A payee's message to an employer does not create that order.
LAD can assess legal aid for maintenance-arrears recovery subject to means and merits tests. SWD can refer and separately assess living support. Legal costs, recovered money and interaction with public assistance have rules; legal aid is not unconditional free representation or government payment of every debt owed by a former partner.
Enquire, apply and follow up
- Keep the full order and list due, received, date and balance by period, retaining banking and messages. Separate orders from private agreements instead of assuming every verbal promise uses identical court enforcement.
- Ask official court-procedure information or legal support about the enforcement route with known income sources and arrears, without threatening the employer yourself. Address or cross-border issues require the relevant legal process.
- For legal aid, prepare financial and case evidence and ask about contributions, costs and recovered funds. Low income does not establish every fee is waived or that submitting an application provides an immediate assigned lawyer.
- For unmet living needs, explain the gap and recovery status to family or social-security services in parallel. Report actual maintenance and later recovery as required for existing assistance, retaining instructions and avoiding double-counting money in the budget.
Limits and other arrangements
There is no universal automatic payment replacing all missed maintenance instalments. Recovery depends on procedure and circumstances; a court order does not equal immediate bank credit. Assessment of support for current living needs proceeds separately.
For violence, threats or immediate danger, prioritise safety and police assistance. Debt enforcement does not replace crisis support. Changed amounts or circumstances may need a formal variation; check consequences before treating chat messages as amendment of an existing order.
A usable example
After three partly paid instalments, the payee lists due and received amounts against the order and asks about enforcement and aid with bank evidence. A worker separately hears the child's food and care needs. Later recovery is reported under existing assistance requirements.
Prepare the arrears worksheet: partial payments, older sums and variations
Start with the complete sealed order and subsequent variations, identifying amount, start date, payment cycle, payee and method before building an arrears sheet. HYAB describes different enforcement routes and the Judiciary lists the governing legislation. The suitable route, permission for older sums, service and overseas issues require advice against the actual order and case facts rather than a generic instruction to recover every sum the same way.
- Use one row per instalment for due date, amount due, amount received, receipt date and difference, matching numbered bank evidence. Record catch-up payments, cash and disputed payments directly to another person separately and ask the adviser how they should be treated. Do not omit an inconvenient receipt or silently decide that every third-party payment must count, or cannot count, as maintenance.
- Separate principal arrears, proposed interest and future instalments that are not yet due, marking unsupported entries for checking. Label the years of older arrears clearly and ask about permission or timing requirements at the advice appointment. A spreadsheet organises numbers; it does not interpret the order, decide an interest entitlement or establish that every historical instalment can be enforced without further procedural steps.
- Update the balance after every receipt and retain the submitted version alongside later changes. If the payer reports unemployment or asks for a reduction, enquire separately about variation. Reconcile any new order under its terms rather than assuming a chat exchange erases all arrears. Accurate updates also prevent a pending enforcement claim from continuing to include sums already received.
Worked example: two partial receipts across three instalments
The payee makes three rows against a monthly order and links each partial receipt to its bank record before asking about enforcement. A reduction request is shown separately to the adviser, while a family centre addresses the child's current living gap. Later receipts update the worksheet and are reported under existing assistance requirements, keeping future and already received sums out of the outstanding-arrears total.
Calculate arrears by period, check formal enforcement and legal aid, and seek living support separately.
