Easter Monday becomes a statutory holiday from 2026; it falls on 6 April that year, bringing the statutory total to 15. Dates such as Ching Ming, the Buddha's Birthday, and Chung Yeung also require attention where they coincide with a worker's rest day. Apply the employment rules to the actual roster instead of copying a general-holiday calendar.
Entitlement to the statutory holiday is distinct from holiday pay, which requires at least three months under a continuous contract immediately before the holiday. The statutory list also gives the employer a choice between Chinese Winter Solstice and Christmas Day; both are not automatically included in the 15-day minimum.
What to check and prepare now
- Place the Labour Department's 2026 list beside the contract's holiday arrangements, then mark actual rest days and leave already taken. This makes it possible to distinguish a missed statutory day from extra leave offered by the employer.

A practical example
If Sunday is your rest day, Chung Yeung on 18 October 2026 overlaps it. Labour's example grants the holiday on 19 October, provided that day is not another excluded holiday or rest day. A shift worker needs their own roster; a friend's office closure does not establish the same arrangement.
Scope, exceptions, and common confusion
An employer cannot buy out the statutory holiday simply by making a payment. Annual leave, rest days, and statutory holidays have distinct rules, while better contractual terms need their own review. Avoid describing every general holiday as an automatically paid statutory day for every employee.
