The July 2026 government reply explains relevant Hong Kong consumer-contract and trade-description rules apply to online traders. Moving to private messages does not eliminate them. Distinguish trading businesses from occasional private resale, and do not assume a listing or payment platform is the actual seller of every item.
Check legal or business name, reachable contacts, model and condition, origin, charges and refund terms. Ratings, polished images and an 'official' label are not a contract or authenticity guarantee. A promotion countdown is not a reason to skip verification.
A practical sequence
- Save listing, specifications, price and seller details and ask about condition, missing parts and delivery. Establish whether photos show this item instead of treating an illustrative image as physical inspection.
- Ask payment, collection, cancellation and dispute terms and clarify recipient-name mismatches. Check consequences if off-platform payment removes protection rather than overlooking them for a discount.
- Use the applicable official payment and retain the order and receipt. Do not provide login or codes to confirm a purchase. For expensive or controlled goods, check safety, permits and authenticity separately.
- Check condition on receipt and report discrepancies promptly in the formal case, keeping packaging and messages. Customs handles suspected unfair trade, Consumer Council conciliation addresses disputes, and suspected fraud uses police and payment-security channels.
A record or question to use
Before ordering ask whether it is a trader or private resale, who sells and receives payment, the model and condition, delivery and problem or cancellation process. Save replies with the listing and verify a different recipient before paying; a chat account alone is insufficient identification.
Limits and where to seek help
Platform protection follows its conditions, without universal cooling-off or guaranteed refunds. Customs enforcement does not recover every price and conciliation cannot compel payment. For cross-border transactions check referral and applicable law, rather than assuming a local address represents the overseas merchant.
