The Small Claims Tribunal generally handles eligible monetary claims not exceeding HK$75,000; a larger claim cannot be split to fit the limit. Employment, possession of land, maintenance and certain tort matters are outside its remit. Check the proper forum before organising, rather than treating the amount ceiling as eligibility for every dispute.
Judiciary guidance identifies contracts, payments, photographs and first-hand material among evidence, with the party responsible for proving the claim. Use four parts: short timeline, itemised amount, document index and open questions. Keep original files separately from organised copies; do not crop away context or rewrite messages afterwards.
A usable sequence
- Check scope, the other party's legal name and address and explain the amount and basis. A shop sign or chat nickname does not necessarily identify the appropriate defendant for filing.
- List transaction, problem, request and reply by date, linking each to a document number. Explain principal and any additional sum and account for refunds or payments so the same loss is not counted twice.
- Prepare legible complete copies and an index, retaining originals and electronic files. Follow the tribunal's copy and submission directions. Identify witnesses with actual knowledge rather than treating a retold account as direct observation.
- Use current forms and the Registry or permitted electronic-filing route, saving the receipt and hearing or supplementation directions. An ordinary email attaching a folder is not automatically valid filing, and enforcement after judgment is a separate procedure.
An example and wording to adapt
An index might read: 'A1 contract: promised service. A2 payment: amount paid. A3 problem photographs: actual condition. A4 refund request and reply: dispute. Calculation: remainder after any refund.' Preserve dates and sources; a printed summary without supporting documents does not establish the underlying facts.
Official next step and limits
Lawyers do not represent parties in the tribunal, while eligibility and evidence still depend on the actual case. The folder is a preparation method, not a success guarantee. Filing, service, hearing and enforcement have separate procedures; creating a folder alone does not start or complete recovery.
