Checking minimum wage requires the relevant hours, wage components, coverage, and effective date. A monthly salary divided by working days is not enough. Organise a calculation that the employer or Labour Department can review.

Current position and effective dates
The statutory rate increased from HK$42.10 to HK$43.10 per hour on 1 May 2026. In a wage period spanning that date, apply the revised rate to hours on or after 1 May rather than retrospectively applying it to the entire period. Coverage does not depend on first satisfying the continuous-contract requirement.
The monthly monetary cap for hours-recording rose to HK$17,600. Compare wages payable under minimum-wage rules, excluding payments for non-work time such as rest days or holidays. For a wage period other than a calendar month, adjust the cap proportionally. Where minimum wage applies and the relevant wages fall below that applicable cap, the employer must retain total-hours records. A headline monthly salary of HK$17,600 does not establish exemption from recording or from minimum-wage protection.
What to check and prepare now
- Retain clock records, rosters, the contract, and payslips, then list daily hours and the wage period. Mark any period spanning the rate-change date so the calculation can distinguish the applicable hours.
- Use Labour's guidelines to check time on duty, meal and rest arrangements, and which payments count for minimum-wage purposes. Do not assume every minute on the premises or every allowance receives identical treatment.
- Ask the employer for the calculation basis and how a possible shortfall will be addressed. Take original records to Labour if unresolved, keeping the enquiry date and response rather than relying only on an informal estimate.
A practical example
For a wage period covering April and May, separate the hours before and after 1 May and check the countable wages using the respective rates. A monthly payroll still needs the relevant hours and payment treatment. A salary that feels substantial is not a substitute for the underlying calculation.
Scope, exceptions, and common confusion
Live-in domestic workers and specified student interns and work-experience students have exclusions. Employees with disabilities also have a separate optional productivity-assessment arrangement. Do not present HK$43.10 as the domestic-helper minimum wage or as a universal price for every kind of work.
