When a landlord announces a visit, establish the purpose, attendees and contractual basis. Repairs, viewings, sales photography and emergencies need different arrangements. Do not import another jurisdiction's twenty-four-hour rule into a Hong Kong tenancy.
What to have ready
Read the clause against the specific purpose
Find the clauses for inspection, repair, viewings and the final tenancy period and record notice method and timing. Agreements differ; wording in one template is not a statutory deadline for every tenant. If unclear, ask the lessor to identify the basis and obtain RVD advice. Do not turn an access disagreement into an unsupported assertion that the whole tenancy has ceased to apply.
Translate a contractor visit into a stated task and area, separating a leak inspection from sales photography. For a claimed hazard, ask what is happening and which utility or management team is involved. Fire, gas and other immediate risks need emergency handling. An ordinary contractual dispute is not a substitute for rescue decisions, and evidence should be recorded only from a safe position.
Agree attendees, entry and completion
Confirm date, window, person or company, contact and accompaniment in retainable messages. If unavailable, offer workable alternatives instead of only saying no. Verify visitors through known contacts. A management-office registration process does not itself resolve tenancy access arrangements, and an unsolicited caller should not receive lock codes or access-card details. Keep the agreed purpose available to the person meeting the visitors.
For spare-key access, specify whether permission covers one or repeated visits, permitted areas and completion notification, and record return of the key. Before photographs, put personal documents away and ask about purpose, recipients and retention. Privacy questions depend on the personal data and use involved; do not assume every room photograph is unlawful or that any image can be published without consideration.
Record completion and departures from the arrangement
- After a repair visit, note actual arrival, attendees, work and unfinished points and safely photograph relevant before-and-after condition. Request the report. Agree quotations and payer separately; permission to enter is not unlimited approval for extra work.
- For an unarranged visit or access beyond the agreed scope, preserve messages and a factual timeline and request an explanation and future arrangement. Avoid guessing motives or posting full addresses and identity details; provide relevant evidence to the appropriate assistance channel.
- Ask RVD about mediation for repeated disputes. Threats, utility interference or pressure to leave require the relevant tenancy-law and urgent-support route. Access rights and remedies depend on documents and facts; do not use an unexplained rent deduction as the solution.
Example: repair access and sales photos in Tai Kok Tsui
Wing agrees to a Saturday plumber visit, then learns the landlord also wants buyers to photograph the flat. She separates the requests, confirms repair attendees and checks the viewing clause before arranging another visit. When the desk is to be photographed, she removes bank correspondence and asks whether images will be used online, preventing personal information from travelling with property marketing photos.
She obtains the work record and confirms key return. If another visit occurs without arrangement, she uses the saved agreement to seek an explanation. This routine improves accountability without claiming an absolute right to refuse every entry or treating ownership as a complete answer to when and how access may occur.
Record purpose, people, timing and privacy separately and use proper emergency support when needed.
