Before you start
IPD explains that registering a business or company name does not automatically confer the right to use or register it as a trade mark. Search similar marks in relation to the intended goods and services, and recognise that an application still undergoes examination and other stages. A domain or social-account name is not Registry approval. Hong Kong searching and registration should not be presented as evidence of protection in mainland China or Macao.
What to do, step by step
- Describe the goods and services on which the brand will be used, including concrete near-term plans. List words, Chinese translations, sounds and logo versions. Searching only one exact spelling can miss a similar mark relevant to the customer's perception and the business's intended activity.
- Use IPD's free system to inspect registered and pending marks, checking owners, classes, descriptions and status. Also review company names and real market use. Bring potentially conflicting results to a trade-mark professional rather than treating a no-exact-match screen as a legal clearance opinion.
- Decide whether the company or an individual should own the mark and verify rights in commissioned artwork. Prepare goods, services and classes using the T2 instructions. Budget separately for official filing charges, professional work and potential objections or disputes, avoiding an assumption that the initial filing fee covers every later step.
- Save the application reference and monitor official correspondence, publication and opposition periods. Describe application status accurately in public materials before registration. After completion, calendar renewals and any separately planned cross-border filings, keeping proof of ownership available for platforms or commercial partners that request it.
Costs, timing, and things to check
The number of classes does not itself define protection for every product; descriptions must fit the actual business. Changing a font or adding a generic word may not resolve similarity concerns. Assess the complete mark and relevant activities before investing in a replacement design.
When a founder leaves, domains, social accounts, artwork and trade marks may be controlled by different people. Document management and transfer arrangements at startup. Possession of an account password can help operate a channel but does not establish the legal rights in the brand.
A practical example
A Hong Kong coffee brand plans to sell beans and operate a café. It searches the word, Chinese name and logo against relevant activities, checks artwork rights with the designer and names the company as applicant. A proposed Shenzhen branch triggers separate mainland clearance and filing work. The Hong Kong T2 receipt remains evidence of that particular application rather than proof that both markets are protected.
