Current position and effective dates
From 1 January 2026, the changes extend no-smoking areas to public places within three metres of entrances or exits exclusively used for specified facilities, including schools and hospitals. Specified queues and boarding locations also have restrictions. The fixed penalty for smoking offences increased to HK$3,000. Read the defined locations and queue conditions rather than generalising to every doorway or wait.
The public-place possession ban for specified alternative smoking product substances, such as e-liquid, capsules, and heat sticks, took effect on 30 April 2026. It adds to the import and sale restrictions in place since 2022. Travellers must check import rules independently; an item not being used at that moment does not establish that carrying it into Hong Kong is allowed.
What to check and prepare now
- Before travelling, check TACO's product definitions and public-place rules against the actual substance or product. A marketing name, overseas legality, or a friend's past experience is insufficient evidence of permission.
- At hospitals, schools, care homes, transport boarding points, and queues, check the entrance, surrounding area, and venue instructions. Ask the venue or TACO about an uncertain boundary instead of assuming that standing outside removes the restriction.
- For help stopping smoking, use the Department of Health's 1833 183 cessation hotline or an official referral service. Check the service arrangements and discuss suitable support with the responsible professional rather than treating an alternative product as approved medical advice.
A practical example
Waiting for a relative outside a hospital requires checking the dedicated entrance and the regulated three-metre area. A designated bus boarding queue has its own relevant conditions. Calling both places 'outdoors' does not resolve permission. Capsules in travel luggage raise a separate product and import question, even before a visitor reaches either location.
